Terms of Use

Welcome to Arting (“the Service”, “we”, “our”, “us”). By downloading, installing, or using our iOS app, by accessing our website at arting.art, or by using our venue manager portal at manager.arting.art, you agree to these Terms of Use. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and meet this requirement.
The Service displays art exhibitions that may include mature artistic themes, including but not limited to nudity, violence, or other adult content. The Service is not intended for children.
If you are under 18 years old, you represent that you have reviewed these Terms with a parent or legal guardian and they have agreed to these Terms on your behalf.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service (including the iOS app, website, and manager portal) for personal, non-commercial purposes in accordance with these Terms.
Approved Manager account holders are additionally granted a limited license to submit and manage venue and exhibition content through the manager portal, subject to the terms in Section 4.
You may not:
- Reverse-engineer, decompile, or modify the app, website, or manager portal
- Use the Service for any unlawful or unauthorized purpose
- Resell, sublicense, or redistribute the app, website, manager portal, or its content
- Scrape, crawl, or automatically collect data from the website or manager portal without permission
3. The Service
Arting is an art exhibition discovery service available as:
- An iOS app
- A website at arting.art
- A venue manager portal at manager.arting.art
The Service allows users to:
- Browse current and upcoming art exhibitions in San Francisco
- View galleries, museums, and public art locations on an interactive map
- Save favorite exhibitions for later reference (iOS app with iCloud sync)
- Share exhibition links with others
The manager portal allows approved venue representatives to:
- Add and manage venue information
- Create and update exhibition listings
- Upload images for venues and exhibitions
The Service displays information about art exhibitions from third-party venues. We do not control, endorse, or take responsibility for the accuracy of exhibition information, venue hours, or pricing provided by third parties or submitted through the manager portal.
4. Manager Accounts & Content Submission
This section applies to users who register for and use the manager portal at manager.arting.art.
Account Registration
- Manager accounts require registration and approval by Arting
- You must provide accurate information about yourself and your venue affiliation
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
Authorization Requirements
By using the manager portal, you represent and warrant that:
- You are authorized to manage the venue(s) you add or edit (as an owner, employee, or authorized representative)
- You have all necessary rights, licenses, and permissions to upload any images you submit
- All information you provide is accurate and not misleading
You may not:
- Manage venues for which you do not have proper authorization
- Upload images you do not own or have permission to use
- Submit false, misleading, or inaccurate information
- Impersonate another person or entity
License Grant to Arting
By uploading images or other content to the Service through the manager portal, you grant Arting a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, distribute, and create derivative works from such content in connection with the Service, including on the Arting iOS app, website, and promotional materials.
This license survives termination of your account, allowing us to continue displaying historical exhibition information.
You represent and warrant that you have the right to grant this license and that your content does not infringe on the intellectual property rights or other rights of any third party.
Content Standards
All content submitted through the manager portal must:
- Be accurate and not misleading
- Not infringe on any third-party intellectual property rights
- Not be unlawful, harmful, threatening, abusive, or offensive
- Comply with all applicable laws and regulations
Prohibited Content
You may not upload or submit content that:
- Infringes any copyright, trademark, or other intellectual property rights
- You do not have authorization to use or share
- Is defamatory, obscene, or unlawful
- Contains malware, viruses, or harmful code
- Violates any applicable law or regulation
- Impersonates another person or misrepresents your affiliation
- Is fraudulent, false, or misleading
5. Content Removal & Account Termination
Content Removal
We reserve the right to remove any content submitted through the manager portal at any time, for any reason, without prior notice to you. This includes, but is not limited to, content that violates these Terms or that we determine is inappropriate.
Account Suspension & Termination
We may suspend or terminate your manager account at any time, for any reason, at our sole discretion, including but not limited to:
- Violation of these Terms
- Submission of unauthorized or infringing content
- Inactivity
- Any other reason we deem appropriate
Upon termination, your right to use the manager portal ceases immediately. Content you have submitted may remain on the Service at our discretion.
6. Third-Party Content
Exhibition information displayed in Arting comes from galleries, museums, other venues, and manager portal submissions. You are responsible for:
- Verifying exhibition dates, times, and admission fees directly with venues
- Your decisions to visit venues based on information in the Service
We are not liable for the accuracy, availability, or changes to third-party exhibition information or content submitted through the manager portal.
7. Data & Privacy
Your privacy is important to us. Please refer to our Privacy Policy for details on how we handle information.
For general users of the iOS app and website, we do not collect personal data.
For manager portal users, we collect account information necessary to provide the service, including your email address and venue affiliation. This information is used solely for account management and communication regarding the Service.
8. No Warranty
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, about the Service’s operation, reliability, accuracy of exhibition information, or fitness for a particular purpose.
Exhibition availability and details depend on third-party venues and manager portal submissions that may change, become unavailable, or be modified at any time.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising out of your use of the Service, including but not limited to:
- Inaccurate exhibition information
- Changes to venue hours or exhibition dates
- Closed or cancelled exhibitions
- Loss of data stored on your device
- Removal of content submitted through the manager portal
- Suspension or termination of manager accounts
- Any claims arising from content submitted by manager portal users
10. Indemnification
You agree to indemnify, defend, and hold harmless Arting, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of any third party
- Any content you submit through the manager portal, including claims of intellectual property infringement
- Your violation of any applicable law or regulation
This indemnification obligation will survive the termination of these Terms and your use of the Service.
11. Copyright Infringement (DMCA)
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a written notice to our designated agent at hello@arting.art containing:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location on the Service
- Your contact information (address, telephone number, and email)
- A statement that you have a good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing content and notify the content provider. Repeat infringers will have their accounts terminated.
12. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights.
Informal Resolution
Before initiating any formal proceeding, you agree to first contact us at hello@arting.art and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If informal resolution fails, any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in San Francisco, California, unless you and Arting agree otherwise.
Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and Arting individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Exceptions
This arbitration agreement does not apply to: (a) claims for injunctive relief; (b) claims related to intellectual property rights; (c) small claims court actions within that court’s jurisdiction.
Opt-Out
You may opt out of this arbitration agreement by sending written notice to hello@arting.art within 30 days of first using the Service. If you opt out, the Governing Law section applies.
13. Changes to the Service & Terms
We may update or discontinue the Service (or features within it) at any time without notice. We may also update these Terms; changes will take effect when posted on our website.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
15. General Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Arting regarding the Service and supersede all prior agreements and understandings.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet service failures.
16. Open Source Acknowledgments
Arting may include open source software components. Applicable licenses and attributions are available within the iOS app.
